July 8. 1996 H <br />Jeanne Mabusth <br />Building and Zoning Administrator <br />City of Orono <br />PO Box 66 <br />Crystal Bay, MN 55323 <br />, V <br />RE:Land Use Application #2153 <br />John and Janice Hurd <br />2795 Casco Point Rd. <br />Variance Request <br />I strongly oppose the above-captioned variance request of John and Janice Hurd scheduled for <br />public hearing before the Planning Commission on July 15, 1996 for the following reasons: <br />1. The Lakeshore View Line and the 75-250’ setback area was established for a specific purpose <br />- to protect all lakeshore land owners, to preserve their rightful enjoyment of viewing the <br />lake and the natural contour of the lake setting. I will not approve of any request that would <br />be to the detriment of existing land owners. <br />2. The variance request is not an add-on to an existing home, but rather a brand new <br />construction in which the present land owners have specifically designed their new home for <br />their own personal satisfaction with no regard for the setback requirements, or the boomerang <br />effect it could have on the entire neighborhood. <br />3. The request for variance would add approximately 24 ’ to the encroachment, thus greatly <br />reducing the view angles of homes located at 2797 Casco Point Road and 2799 Casco Point <br />Road. <br />4. If the variance request is granted, what is to stop new and/or abutting land owners to continue <br />to build new and larger dwellings closer and closer to the lakeshore and continue the neglect <br />of the view line and the 75-250’ setback area. <br />I request that the City of Orono enforce the existing View Line and the 75 - 250 ’ setback area. I <br />request that any existing dwellings that are being replaced by new construction be contained <br />within the existing View Lines and the 75 - 250 ’ setback area guidelines.
