Request for Council Action continued <br />pages <br />August 30, 1996 <br />Zoning File #2151 John and Janice Hurd, 2795 Casco Point Road <br />Planning Commission members u'ere asked to consider reductions in either proposed or existing <br />improvements to offset the 427 s.f. excess of total hardcover on the property. Planning <br />Commission members accepted the hardcover as proposed in the revised plan based on the <br />unique findings or hardships set forth by applicant and as noted by members at both the July <br />and August meetings as follows: <br />A.Residence structures along this section of lakeshore are located 175+' from <br />shoreline restricting placement of structure on property. <br />B. <br />C. <br />The majority of residences are located to the east or street side of property. <br />The boathouse at 400 s.f. in area is in excellent condition and has been <br />maintained by owners. Both neighbors on adjacent properties have asked that <br />the structure remain because of its attractiveness. <br />D.The higher elevations at the residential construction line eliminates any view <br />impact by the single storj' boathouse at the lakeside. <br />E.Placement in approximate footprint of existing residence will eliminate need to <br />remove trees and the further excavation into the higher elevation. The majority <br />of runoff from the developed site will drain towards lakeshore over the extensive <br />180' of grassed yard. <br />F.The property is located on the point of the shoreline and as a result of the angle <br />of the shoreline, the structure is located further from the shoreline than the <br />neighboring houses. <br />G.The homeowners, receiving most impact by new improvements, have approved <br />the redevelopment plan for the property. <br />Planning Commission Recommendation <br />The Planning Commission recommended approval (4 ayes, 1 nay) of the Hurd variance <br />application as amended for the August meeting based on the unique findings and hardships set <br />forth above. Approval was conditioned on applicants providing an amended survey with <br />building permit application locating the Theilmann residence to confirm the agreed upon <br />lakeshore setback line by neighbors. In my discussions with Mr. Hurd, he has advised that he <br />would attempt to provide the updated survey for the Council meeting. The denial of the <br />application was from Chairman Peterson who has consistently voted against any encroachment <br />of the average lakeshore setback line. <br />\
