Zoning File #2158 <br />August 2, 1996 <br />Page 3 <br />Existing Uses & Zoning of Adjacent & Nearby Properties <br />The residential neighborhood (Zoned LR-IC) abutting the subject property consists of single <br />family homes on small lots generally gaining access from Olive Avenue, and those further <br />north from Bay view Place. Directly to the east of the site, the wetland outlot (Zoned LR-IB) <br />is not a buildable parcel, and the Lafayette Ridge neighborhood is some 600’ distant. <br />The adjacent parcel directly to the southeast is zoned B-1. Retail Sales Business District and <br />will be the site of a restauranl'convenience store/gas statioa'car wash complex. To the <br />immediate south of County Road 15 is an existing convenience store operation, zoned B-1. <br />Southwest of the intersection of County Roads 15 and 19 is Rick’s Super V'alu, which is zoned <br />B-3, Shopping Center Business District. Directly across Shadywood Road from the site, in the <br />northwest quadrant of Co. Rds. 15/19, is an Amoco service station as well as a professional <br />office building and a single family residence, all zoned B-1. Just to the north of LjTic Avenue <br />on the west side of 19 is a City playground. <br />B-5 District Proposed <br />Applicant proposes a rezoning to B-5 Limited Neighborhood Business District. The B-5 <br />standards were created in 1976 and exist today as originally adopted. The purpose of the B-5 <br />District is defined in the Zoning Code as follows: <br />"The B-5 Limited Neighborhood Business District is intended to <br />provide a district for businesses that supply commodities or <br />perform a ser\ice primarily for residents in the surrounding <br />neighborhood, which businesses are not high traffic generators and <br />do not necessitate an inordinate amount of hardcover. The <br />District may adjoin residential districts or other business districts <br />which are subject to more restrictive controls. <br />The District shall have immediate access to adequate highways <br />and public sanitary sewer. Because of the location of the B-5 <br />District as contemplated in the area known as Navarre in the City <br />of Orono, the uses are limited in order to limit the hardcover in <br />that area and to limit the future generation of traffic for that <br />property in that use district since there is already a traffic problem <br />in Navarre." <br />Planning Commission should carefully consider whether all of the permitted uses in the B-5 <br />zone as listed below are appropriate for the property in question.
