CITY of ORONO <br />RESOLUTION OF THE CITY COUNCIL <br />NO. <br />5 The City Council finds that the conditions existing on this propertv' are peculiar <br />to it and do not apply generally to other property in this zoning district; that <br />eranting the variance would not adversely affect traffic condiuons, light, air nor <br />pose a fire hazard or other danger to neighboring property; would not merely <br />sen-e as a convenience to the applicants, but is necessary to alleviate a <br />demonstrable hardship or difficulty; is necessary' to preserve a substannal property- <br />right of the applicants; and would be in keeping with the spint and mtent of the <br />Zoning Code and Comprehensive Plan of the City. <br />CONCLUSIONS, ORDER AND CONDITIONS <br />Based upon one or more of the above fmdings. the Orono Ciy Council hereby <br />eranis variances to Municipal Zoning Code Sections 10.22. Subdivisions 1 (B) and - to permit <br />fhe construction of a two story entry addition, a second stoo' den addition <br />and the installation of a 5' x 3’ landing and spiral staircase at the lakeside of the residence, <br />subject to the following conditions: <br />Authorities granted bv this variance run with the property not with Ae aPP^*can“’ <br />but are permissive only and must be exercised by application for ^ buildm <br />permit within one year of the date of Council approval, or this variance will <br />expire on that date (May 10, 1994). <br />Violation of or non-compliance with any of the terms and conditions of to <br />resolution shall constitute a violation of the zoning cto shall <br />terminate any authority granted herein, and shall be pumshable as a mi demeanor. <br />The undersizned applicants have read, understood and hereby agree <br />^this resolution and on behalf of themselves, their <br />hereby agree to the recording of this resolution m the cham of title of the <br />property. <br />1. <br />2. <br />3. <br />Page 3 of 5
