14. In review of the factual findings noted above, the Council finds that granting of the <br />proposed variances to allow construction of the proposed room addition would be <br />in complete conflict with the environmental standards for lakes.hore development <br />within the City and would be detrimental to the public health, safety and welfare. <br />The City also looks to the broader environmental principles and goals set forth in <br />its Community Management Plan and the intent of the specific zoning district <br />standards when dealing with matters of public health, safety and welfare. Issues <br />involving public health, safety and welfare are not only resolved by securing the <br />obvious traffic and drainage concerns, but the City is obligated to provide the <br />citizens with a designated and optimum level of density, open space and quality of <br />life. <br />FURTHER BE IT RESOLVED, that the applicant shall remove the deck within <br />thirty (30) days of the date of this resolution. Further, applicant shall obtain an after-the-fact <br />permit for reconstruction of the lakeshore stairway system and shall bring said stairway system <br />into conformity by reducing the width of the 6' x 13' platform to 4' in width, such action to be <br />completed within thirty (30) days of the date of this resolution. Non-compliance with either of <br />the above noted conditions shall constinite a violation of the zoning code, and shall be punishable <br />as a misdemeanor. <br />Adopted by the City Council of the City of Orono on this 12th day of August, 1996. <br />ATTEST: <br />Dorothy M.
