When the approval resolution was presented for Council adoption on July 22, Council's <br />motion to adopt the resolution failed on a vote of 2 to 3. The item was then tabled on a vote <br />of 5 to 0 in order that applicant consult with his attorney on this change of direction by the <br />Council. <br />In attempting to anticipate the possible actions Council may wish to take on this application, <br />a draft denial resolution and the previously presented approval resolution with language added <br />regarding Council's intent are enclosed with this packet. <br />The applicant ’s attorney has submitted an additional letter (Exhibit requesting Council's <br />reconsideration of various facets of this application. <br />COUNCIL ACTION REQUESTED: <br />Adopt one of the attached resolutions as drafted or with revisions you may specify. <br />Isv <br />i
