The <br />trails as shown on the plat provide pedestrian access to the Luce Line Trail and adjacent DNR <br />open space, and to the three acre public open space parcel on Watertown Road. The subdivision <br />plat includes public easements over these trails to ensure public access to the trails. These trails <br />have not be installed at this point. It is staffs understanding that these trails are to be <br />constructed as part of the subdivision. Therefore, it is the responsibility of the developer to <br />install these trails as indicated on the plat. <br />In recent discussions with Dick Putnam of Tandem Properties, with the purpose of determining <br />'the type of surface to be installed on the trails, Mr. Putnam indicated it is his understanding that <br />the Council, prior to or as part of its final action on the subdivision, determined that the internal <br />trails should not be constructed on the Dickey property. It is his recollection that this <br />determination was based on opposition to the internal trails by the residents of Country Side <br />Drive. <br />Since this understanding differs from staffs understanding, and it appears to be different from <br />what is reflected in the Council meeting minutes regarding the subdivision, staff is requesting <br />clarification from the Council regarding whether the Council ’s approval of the subdivision <br />included the construction of the internal trails on the Dickey property. <br />COUNCIL ACTION REQUESTED <br />Motion to clarify the Council ’s intent regarding the construction of the internal trails on the <br />Dickey property portion of the Crystal Bay Addition subdivision.
