A RESOLUTION DENYING VARIANCES <br />TO MUNICIPAL ZONING CODE <br />SECTIONS 10.03, SUBDIVISION 14(C); <br />10.22, SUBDIVISION 1 & 2, 10.55, SUBDIVISION 8; <br />AND 10.56, SUBDIVISION 16(L) <br />FILE #2137 <br />WHEREAS, the City of Orono is a municipal corporation organized and existing <br />under the laws of the State of Minnesota; and <br />WHEREAS, pursuant to State Statutes 412 et. seq. and 462 et. seq., the City <br />Council of the City of Orono has adopted zoning regulations for the protection of the public <br />health, safety and general welfare; and <br />WHEREAS, William Dunkley and Susan Dunkley (hereinafter "the applicants") <br />are the owners of the property located at 2709 Walters Port Lane within the City of Orono <br />(hereinafter "the City") and legally described as follows: <br />Lot 4, Block 3, Walters Port, Hennepin County, Minnesota (hereinafter "the property"); <br />and <br />WHEREAS, the applicants have applied to the City for variances to Municipal <br />Zoning Code Section 10.03, Subdivision 14(C) to allow lot coverage by structures to increase <br />from the current level of 15.6% to 16.7% where only 15% lot coverage is normally allowed, <br />and to Section 10.22, Subdivision 1(A) to allow construction of a room addition located 40' <br />from the shoreline of Lake Mitmetonka where a 75' setback is normally required, and to <br />Section 10.22, Subdivision 1(B) to allow encroachment of the average lakeshore setback where <br />no such encroachment is normally allowed, and to Sections 10.22, Subdivision 2, 10.55, <br />Subdivision 8 and 10.56, Subdivision 16 (L) to allow an intensification of hardcover in the 0- <br />75' lakeshore setback zone where no hardcover is normally allowed, all of the above variances <br />required for construction of a room addition housing swimming facilities attached to the <br />existing residence structure; and <br />Page 1 of 5
