CITY of ORONO <br />RESOLLTION OF THE CITk COUNCIL <br />NO. 3 4c <br />WHEREAS, it is the City's intent that in the event Outlets B and D are used in <br />the future for road purposes that such road shall be constructed to City standards. Further, it <br />is the Citv's intent that in order to guar.^nree the future access to Outlet C. applicants shall <br />provide to the City standard road and utility easements over Outlets B and D. It is the City’s <br />funher intent that if Outlet C is developed wiiiiout the need for access via Outlets B and D. that <br />such road and utility casements will be vacated upon formal request of the property ovsners; and <br />WHEREAS, it is the City's intent thaf Outlets A, B and C shall remain in private <br />common ownership until Outlet C is further de\ eloped, and that Outlet D shall remain in private <br />common ownership with p^roposed Lot 1, Blo*ck 2 until Outlet C us further developed, and <br />WHERE.AS, ii is the City's intent that at the lime Outlet C is further developed, <br />the City will at that time require the payment of park dedication fees and me dedication ol any <br />ddiiional necessary and appropriate public ease.mcnts within Outlets .-X. H. C and D; anda' <br />WHEREAS, it is the City's intent that proposed Lot 1. Block I and proposed Lot <br />i. Block 2 grant the standard perimeter utility and drainage easements based on the assumption <br />ihci Outlets B and D will in the future become a roadway; and <br />WHERE.AS, although Hennepin County Depanment of Public Works has <br />requested additional right-of-way for County Road 84. no additional County road right-of-way <br />will be required of the developer consistent with the siand.irds for a coUecior road as defined <br />in the Orono Comprehensive Plan; and <br />WHEREAS, a driveway easement over Outlet B shall be granted in favor of <br />proposed Lot I, Block 1 for ihe existing driveway in Outlet B; and <br />WHEREAS, the existing accessory metal shed located at the northwest corner of <br />Outlet C will becone non-conforming upon final plat approval due to lack of a principal <br />residence structure ar^ must be removed within one year of final plat approval unless it is <br />incorporated into a subaivision of Outlet C into t/uildable lots aut? made conforming at that time. <br />and <br />WHEREAS, the single family residences existing on proposed Lot 1.
