B <br />CITYofORONO <br />RESOLUTION OF THE CITY COUNCIL <br />NO. a _____ <br />A RESOLUTION GRANTING PRELIMINARY <br />APPROVAL OF A REPLAT OF <br />LOTS 2 AND 3, MAPLE PLACE <br />- FILE NO. 2025 <br />M'-HEREAS, Michael R. Plank, May 22. 1995. filed a formal subdivision <br />application with the City for approval of a lot line rearrangement of residential property legally <br />described as: <br />Lots 2 and 3, Block 1. and Outlot A, Maple Place (hereinafter "the property"); and <br />WHEREAS, after due published and mailed notice in accordance with Minnesota <br />Stamtes 462.358 et. seq. and the Cit>' of Orono ’s Zoning and Platting Codes, the Orono <br />Planning Commission held a public hearing on June 19, 1995 at which time all persons desiring <br />to be heard concerning this application were given the opportunity to speak thereon; and <br />WHEREAS, at their regular meeting held on July 10, 1995, tlie Orono City <br />Council considered the subdivision application of a replat of a lot line rearrangement, noting the <br />followuig fmdings of fact: <br />1. The propert)' is located within the RR-IA. Single Family Rural Residential <br />Zoning District requiring a minimum of 5 acres of dr>' lands, 2 acres of which <br />must be contiguous within each newly created lot. <br />2. The property contains a total of approximately 19.34 acres of which 3.61 acres <br />is wetland. Each proposed lot exceeds the 5 acre minimum lot area requirement: <br />Lot 1 <br />Total area = 13.18 acres, 10.63 dry contiguous acres <br />Lot 2 <br />Total area = 6.16 acres. 5.1 dry contiguous acres <br />3. In 1988, Lot 2 w-as tested for a principal and an alternate septic site at the time <br />of new construction. Both sites have been approved by the City. As proposed <br />Lot 1 has over 10 dry acres, septic testing has not been required. <br />Page 1 of 4
