CONCLUSIONS, ORDER AND CONDITIONS <br />Based upon one or more of the above findings, the Orono City Council hereby <br />grants a variance to Municipal Zoning Code Section 10.03, Subdivision 14 (C) to allow lot <br />coverage by structures of 16.7% where only 15% lot coverage is normally allowed, and grants <br />a variance to Section 10.22, Subdivision 1 (A) to allow additional structure less than 75’ from <br />the lake where a 75’ setback is normally required for structures, and grants a variance to <br />Section 10.22, Subdivision 1 (B) to allow encroachment of the average lakeshore setback where <br />no such encroachment is normally allowed, and grants variances to Sections 10.22, Subdivision <br />2, 10.55, Subdivision 8. and 10.56, Subdivision 16 (L) to allow an intensification of hardcover <br />in the 0-75’ lakeshore setback zone where no hardcover is normally allowed, subject to the <br />following conditions: <br />1. <br />2. <br />3. <br />4. <br />Hardcover in the 0-75’ lakeshore setback zone shall be limited to 6,091 s.f. or <br />35.2% in the 0-75' zone per the site plan and hardcover calculations attached to <br />this resolution as Exhibit A. Property owner is advised that any future proposal <br />to increase or intensify hardcover on the property will require a new variance <br />application and is unlikely to be approved, but might be approved only in <br />conjunction with concurrent removal of existing hardcover to result in no net <br />hardcover increase or a net hardcover decrease. <br />Applicant shall adhere to the revised plan submitted for this application in <br />construction of the room addition. <br />Authorities granted by this variance run with the property not with the <br />applicants, but are permissive only and must be exercised by application for a <br />building permit within one year of the date of Council approval, or this variance <br />will expire on that dale (July 8, 1997). <br />Violation of or non-compliance with any of the terms and conditions of this <br />variance shall constitute a violation of the zoning code, shall automatically <br />terminate any authority granted herein, and shall be punishable as a <br />misdemeanor. <br />5.
