5. <br />6. <br />A. The garage will be located adjacent to an unimproved dead end right-of- <br />way not maintained by City. <br />B. <br />C. <br />D. <br />The section of unimproved roadway currently serves as a shared drive for <br />two adjacent properties and is, for the most part, grassed over. <br />To place the structure and access drive further south in rear yard to meet <br />required 10’ setback would result in the loss of mature trees. <br />It is the ^applicant's desire to preser\e as much of their limited grassed <br />yard as possible. <br />E. The structure will have no visual impact upon the surrounding properties. <br />F. The residence to the south is located 60+' from the proposed garage. <br />G. The property is not served by a garage. <br />The City Council finds that the conditions existing on this property are peculiar <br />to it and do not apply generally to other property in this zoning district; that <br />granting the variances would not adversely affect traffic conditions, light, air nor <br />pose a fire hazard or other danger to neighboring property; would not merely <br />serve as a convenience to the applicant, but is necessary to alleviate a <br />demonstrable hardship or difficulty; is necessary to pieserve a substantial <br />property right of the applicant; and would be in keeping with the spirit and <br />intent of the Zoning Code and Comprehensive Plan of the City. <br />The City Council has considered this application including the findings and <br />recommendations of the Planning Commission, reports by City staff, comments <br />by the applicant and the effect of the proposed variance on the health, safety and <br />welfare of the community. <br />Page 2 of 5
