■mm <br />City of OROINO <br />RESOLUTION OF THE CITY COUNCIL <br />NO. ___^11 <br />b) The proposed grade level concrete patio is considered a <br />non-encroachment in the front yard, and is not required to <br />meet the normal 35' setback from the street. No structure <br />above the concrete patio is proposed. <br />c) Total lot area is 10,001 s.f., or 0.23 acres. The <br />majority of the hard surface on the property including <br />house, garage, driveway, and sidewalks, are all generally <br />necessary for usage of the property, hence the opportunity <br />for further hardcover reductions is limited. <br />4. The City Council has considered this application including <br />the findings and recommendations of the Planning Commission, <br />reports by City staff, comments by the applicant and the effect <br />of the proposed variance on the health, safety and welfare of the <br />community. <br />5. The City Council finds that the conditions existing on this <br />property are peculiar to it and do not apply generally to other <br />property in this zoning district; that granting the variance <br />would not adversely affect traffic conditions, light, air nor <br />pose a fire hazard or other danger to neighboring property; would <br />not merely serve as a convenience to the applicant, but is <br />necessary to alleviate a demonstrable hardship or difficulty; is <br />necessary to preserve a substantial property right of the <br />applicant; and would be in keeping with the spirit and intent of <br />the Zoning Code and Comprehensive Plan of the City. <br />CONCLUSIONS, ORDER AND CONDITIONS <br />Based upon the above findings, the Orono City Council hereby <br />grants a variance to the Municipal Zoning Code Section 10.22, Subdivision '* <br />to permit the construction of a grade level concrete patio of dimension? <br />3.5' X 23' which constitutes additional structural hardcover in the 75-250 <br />zone where existing hardcover already exceeds the 25% allowed hardcover, <br />subject to the following conditions; <br />1. Hardcover on the property shall not exceed 4561 s.f. or 45.6% <br />Allowed hardcover shall be as shown in the site plan and calculatioi <br />attached as Exhibit B. Applicants are advised that any future <br />proposal to increase hardcover on the property will not be approved <br />but might be approved only in conjunction with concurrent removals oi <br />existing hardcover, resulting in no net increase of hardcover on th( <br />property. <br />Page 2 of 4
