Review Exhibits A and B, one of the reasons for seeking the total vacation <br />was that applicants ’ drainage plan was based on surface runoff being directed to the northeast <br />or the Church property to a retention pond that would e\entually drain to wetlands in Lafayette <br />Ridge. An underground drainage tile will convey runoff from the O'Sullivan/Smith property <br />to the retention pond and a second will be installed from retention pond to wetland at <br />southeast. Portions of the retention pond also encroach within unimproved right-of-way of <br />Navarre Lane. <br />Applicants ’ title company has asked that applicants gain an easement from the City to permit <br />the drainage facilities within the public right-of-way. Applicants ’ attorney has drafted the <br />enclosed easement. The City Attorney has reviewed the easement and found the easement <br />acceptable. <br />COUNCIL ACTION REQUESTED: <br />To approve the granting of the Drainage Easement to Voyageur Service Centers, Inc. and to <br />direct the Niayor and Clerk to execute the Drainage Easement. <br />Isv <br />i
