CONCLUSIONS, ORDER AND CONDITIONS <br />Based upon one or more of the above findings, the Orono City Council hereby <br />grants variances to Municipal Zoning Code Section 10.22. Subdivisions 1(A), 1 (B) and 2 to <br />permit the reconstruction and expansion of the roof li.ne for a section of roof located 22.6* in <br />front of the average lakeshore setback line, the roof expansion involves a 200 s.f. area of <br />structure located within the 0-75’ setback area where no hardcover is allowed, and grants a 12' <br />or 16% setback variance for the structural improvements to a portion of a structure located <br />within the lakeshore setback area. Approval is subject to the following conditions: <br />1. <br />2. <br />3. <br />4. <br />Upon application for a building permit, applicant shall provide an amended plan <br />and hardcover inventoiy showing expanded backout pad and apron for drive <br />located within street yard. In r.o case shall hardcover exceed allowed 25%. <br />Authorities granted by this variance run with the property not with the <br />applicants, but are permissive only and must be exercised by application for a <br />building permit within one year of the date of Council approval, or this variance <br />will expire on that date (June 24. 1997). <br />Violation of or non-compliance with any of the terms and conditions of this <br />variance shall constitute a violation of the zoning code, shall automatically <br />terminate any authority granted herein, and shall be punishable as a <br />misdemeanor. <br />The undersigned applicants have read, understood and hereby agree to the tenns <br />of this resolution and on behalf of themselves, their heirs, successors and <br />assigns, hereby agree to the recording of t’'1s resolution in the Chain of Title of <br />the property. <br />Page 3 of 5
