3perty <br />lereby <br />lim as <br />ito an <br />;d and <br />14.3% <br />^5-250' <br />eculiar <br />:t;that <br />air nor <br />merely <br />/iate a <br />stantial <br />rit and <br />igs and <br />niments <br />ety and <br />CONCLUSIONS, ORDER AND CONDITIONS <br />Based upon one or more of the above findings or hardships, the Orono City <br />Council hereby approves variances to Municipal Zoning Code Sections 10.22, Subdivision 2 <br />and 10.23, Subdivision 6 (B) to permit additions to the existing structure involving a second <br />story and grants a hardcover variance within the 250-500’ setback area at 895.63 s.t. or 182%, <br />a side street setback variance of 35’ or 70%, a north side setback variance ot 26 5 ’ or 88.3/o <br />and a street setback variance of 5 ’ or 10%. Approval is subject to the following conditions: <br />1.Applicant shall have completed the legal combination of Lots I, 2, 3 and 4 of <br />the Ottoville on Lake Minnetonka plat and the vacated alley prior to applying <br />for a building permit for the new construction. <br />2.Upon application for a building permit, applicant shall provide an updated survey <br />and hardcover inventory including all approved structural and nonstructural <br />improvements. Applicants shall also provide a detailed grading plan showing <br />existing and proposed contour. <br />3.Authorities granted by this variance run with the property not with the applic^t, <br />but are permissive only and must be exercised by application for a building <br />permit within one year of the date of Council approval, or this variance will <br />expire on that date (May 13, 1997). <br />4 Violation of non-compliance with any of the terms and conditions of this <br />resolution . constitute a violation of the zoning code, shall automatically <br />terminate y authority granted herein, and shall be punishable as a <br />misdemi <br />5 The undersigned applicant has read, understood and hereby agrees to the terms <br />of this resolution and on behalf of himself, his heirs, successors and assigns, <br />hereby agrees to the recording of this resolution in the chain of title of the <br />property. <br />Page 4 of 6
