Review Exhibit K, the low retention area drains eventually into the ravine to <br />the southeast of the property’ and then under Tonkawa to an even deeper ravine that drains <br />directly into Stubbs Bay. The steep banks of this ravine are continuously eroding from the <br />runoff that enters from the west. The ra\ ine also receives runoff from the road to the west and <br />the higher elevations on the north and south sides. One major benefit of this proposal is that <br />the improvement will provide control of stormwater runoff of the upland areas within <br />applicant's property. The City will ask for drainage easements over the pond area and over the <br />drainageway that flows to the ravine at the southeast comer (a minimum 10 width), refer to <br />E.xhibit K. <br />1. <br />Staff Recommendation <br />To approve the conditional use permit application for Frank Bennett involving the property <br />located at 405 Tonkawa Road that would allow the dredging of approximately 1900 cubic yards <br />of fill, portions of which will be used to install a new access drive linking applicant's <br />homestead property with subject property. Approval is subject to the following conditions: <br />Applicant to obtain a County permit for any work done within the County right- <br />of-way wiih the removal of existing drive serving 315 Tonkawa Road. <br />If the pond is to serve as a wildlife pond, then side slopes must be redesigned <br />to 8:1 in accordance with the .Army Corps' general permit #18. Applicants <br />consultant to provide written confirmation to the City that pond has been <br />approved by the Corps of Engineers. <br />Silt fence to be installed at the pond outlet (106.6) prior to any land alteration. <br />All disturbed areas to be seeded with a wetland mixture such as MnDOT 250 <br />rather than sod. <br />Applicant to obtain a land alteration permit from the City of Orono. Final plans <br />to include detail on new drive extending north from property ;md removal of <br />existing drive at 315 Tonkawa Road. <br />J
