As planned, the Orono Hockey <br />Boosters. Inc. have filed their formal conditional use permit application that will be reviewed <br />at the April 15, 1996 meeting of the Planning Commission. <br />The property is located within Area 4 of the current Highway 12 corridor study. Section 5 of <br />the Moratorium Ordinance prohibits the granting of conditional use permits or building perrmts <br />within the study area. Council may grant such a variance if the necessary findings set forth <br />in Section 7 of the ordinance can be made. <br />The conditional use permit of the applicant will include a variance involving a parking setback <br />from a street lot line and a parking stall variance, but the school and the hockey group sha <br />enter into a shared parking agreement to offset parking inadequacies. Note the zoning <br />amendment that permitted the ice arena use was not affected by limitations of the moratorium <br />as it was a general code amendment. <br />If Council chooses to waive Planning Commission referral, a public hearing notice c:m be <br />published in time for a hearing at the Council’s April 22nd meeting. A resolution J. <br />prepared for adoption that would allow Council to grant a conditional use permit and City stall <br />to issuf d building permit for the new construction. <br />If Council chooses not to waive referral to the Planning Commission, a public hearing will be <br />scheduled before the Planning Commission at a May 20, 1996 meeting. <br />962.
