COO/VC,
REQUEST FOR COUNCIL ACTION APf^
DATE: Aprijs^l^
ITEM NO,
® i99e
°f>ono
Department Approval:
Name Jeanne A. Mabusth
Title Building & Zoning Administrator
Administrator Reviewed:Agenda Section:
Zoning
Item Description: #2121 Elaine Slechta, 3700 Northern Avenue - Vacation/Division for Tax
Purposes - Resolution
Zoning District: LR-IC
Total area = 4+ acres (1/3+ acre designated wetland)
Brief Review of Application
For more detail on the review of this application, please refer to the staff memo enclosed dated
March 11, 1996 and the minutes of the Planning Commission meeting of March 18th.
The comprehensive application involves a petition to vacate Northern Avenue originally vacated
by the Orono Town Board in 1912. The application also involves the division of three parcels
legally combined for tax purposes. Each of the parcels exceeds the required lot area and lot width
standards at a half acre and 100'. Refer to E.xhibits N and O. Tract B's building envelope is
divided in half by a designated wetland. Staff has approximated the area of the building envelope
south of the designated wetland at 22,071 s.f. As required r / ,*ode, the building envelope will
still meet the minimum half acre in area (21,780 s.f.).
N* *mally a simple division for tax purposes can be completed as a Class I subdivision. As the
.i-'-rent application involves a vacation, dedication of road, dedication of drainage and utility
easements and drainage easement over a designated wetland, the subdivision must be completed
as a plat.
No park fees are required as we are dealing with previously platted lots that meet current lot
standards combined for tax purposes. The City Engineer has specifically asked that basement
elevations for the new construction not be below the 951 elevation in order to allow for adequate
clearance below footing and grade ol the sewer service pipe.
Vacation of Northern Avenue
The Orono Town Board vacated Northern Avenue on August 21, 1912. That action was never
cenified on the Certificate of Title of Tracts B and C created in June of 1958. In fact, the RLS
: i:. ^
