A RESOLUTION VACATING <br />an unimproved alley within the plat of <br />HILLSIDE PARK <br />IN THE CITY OF ORONO, <br />HENNEPIN COUNTY, MINNESOTA <br />FILE NO. 2120 <br />WHEREAS, the City of Oiono is a municipal corporation organized and existing <br />under the laws of the State of Minnesota; and <br />WHEREAS, on Februaiy 23, 1996, Loren Brueggemann (hereinafter the <br />In^plforH^rP^rt. <br />Hennepin County, Minnesota in 1912 and legally described as tollows; <br />that part of the east-west alley as platted in "Hillside Park , according to <br />the recorded plat thereof. Hennepin Count)-, Minnesota, which lies <br />southerly and adjacent to Lot 12, Block 1, said "Hillside Park", Hennepin <br />County, Minnesota; and <br />WHEREAS, after due published and posted notice, a public hearing was held <br />by the Citv's Planning Commission on March 18, 1996, regarding said vacation and a <br />interested persons were given an opportunity to be heard, and <br />WHEREAS, after due standing and consideration, the Planning Commission <br />recommended unanimous approval of the proposed vacation; and <br />WHEREAS, the Citv Council of the City of Orono finds that said vacation as <br />proposed is in keeping with the public interest and in consideration of the following findings: <br />1.The majoritv of the 10 ’ alley is located within the lake bed of Lake Minnetonka <br />below the Ordinary High Water Level of 929.4. The entire western pomon of <br />the alley is located within the lake bed restricting land access to the limited <br />eastern portion of the alley from Westlake Street. <br />Paee 1 of 2 <br />1
