Decks that replaced over non-structural hardcover also need variances if the <br />amount of existing hardcovder exceeds the requirements. <br />Statement of Hardship <br />The existing deck is rotted and is a safety problem. The residence is designed to have an upper deck. <br />Criteria for Determining Undue Hardship <br />1. The property in question cannot be put to a reasonable use if used under conditions <br />allowed by the official controls. <br />The variance is to replace an existing deck. The dwelling can continue to be used <br />as a residence without the deck, however, it is existing and the house is designed to include <br />the deck. <br />2. The plight of the landowner is due to circumstances unique to his property not created <br />by the landowner. <br />The plight of the landowner is created by the condition of the existing deck and the amount <br />of hardcover on the property. <br />3. The variance, if granted, will not alter the essential character of the locality. <br />4. <br />5. <br />The variance will not change the character of the area. <br />Economic considerations alone shall not constitute an undue hardship if reasonable <br />use for the property exists under the terms of this chapter. <br />Economic factors are not a consideration with this application. <br />Undue hardship also includes, but is not limited to, inadequate access to direct sunlight <br />for solar energy systems. <br />Solar access is not a consideration. <br />6.
