1 <br />LAKESHORE SETBACK <br />3. Section 10.22, Subd. 1, B., Lake shore Set Back Regulations <br />The setback from the shoreline for lakeshore lots: <br />B.No principal or accessory structure shall be located within 75 feet of the lakeshore <br />nor closer to the lakeshore than the average distance from the shoreline of existing <br />residence buildings on adjacent lots. <br />The entire site is in the 75' setback from the shoreline. ITie proposed residence would encroach into <br />the lakeshore setback approximately 38 ’ forward of the 75' setback line. The proposed residence <br />encroaches approximately 63' into the 75' setback from the lagoon. <br />AVERAGE LAKESHORE SETBACK <br />4. Section 10.56, Subd. C, 6., Average Lakeshore setback <br />No principal or accessory structure shall be located closer to the lakeshore than the average <br />distance from the shoreline of existing residence buildings on adjacent lots, except that this <br />does not apply to stairways, lifts, landings, and lockboxes. Further, the average lakeshore <br />setback shall apply only to classified lakes, and shall not apply to tributaries. The average <br />lakeshore setback line shall be a straight line connecting the most lakeward protrusions of <br />the residence buildings on the immediately adjacent lakeshore lots. <br />The proposed residence is forward of the adjacent residence to the northeast. The proposed <br />residence is also forward of the residence to the west w hich is separated from the subject <br />property by the lagoon. 1 he proposed residence encroaches approximately 65' forward of <br />the average lakeshore setback line. <br />FLOOD PLAIN AND WETLANDS MANAGEMENT <br />5.Section 10.55, Flood Plain and Wetlands Management, Subd. 4, B., Flood Fringe District <br />(FFD) <br />The Flood Fringe District shall include those areas designated as floodway fringe in the <br />Flood Insurance Study, including without limitation the shoreline of Lake Minnetonka <br />between elevations 929.4 MSL and 931.5 MSL, the area between the floodway and the edge <br />of the 100-year flood on all other lakes, ponds and streams, all designated sheet flow areas, <br />all intermittent streams, and ponding areas and all lands containing soil types classified as <br />wetland soils, whether or not there is water standing on those soils at any given time. <br />U222I Sven Washerg and Arlene DeCandia <br />3115 North Shore Dr.-Variances <br />4/21/97 <br />page-3
