Bieker, 2440 Old Beach Road - Conditional Use <br />Permit - Resolution <br />Zoning District: LR-lB <br />Brief Review of Application <br />Applicant seeks approval of a conditional use permit that would allow the installation of a permanent <br />dock at the residential propert>\ The t-shaped dock measures 24’ in total length and will be located <br />out of a channel dredged in the mid 70s. The dredged channel is located 30’ from the shore. <br />The DNR will require a permit as structure is not a single linear dock. Review Exhibit L, the <br />Minnehaha Creek Watershed District will not require a permit review. Applicant has filed the <br />building plan and site plan with the LMCD and they advised staff that they have not completed their <br />review of the dock plan. Greg Nybeck of the LMCD advised that he would contact my office on <br />Monday to let me know if he saw any problem. Based on the information provided by Mr. Nybeck, <br />the dock would meet the required setback from the extended north side lot line. The setback is <br />shown at 21’ and the side loading slip is 20’ in lengtlt. The LMCD would require a minimum 20’ side <br />setback. <br />Construction plans have been amended per the City Engineer’s review comments (review E.xhibits <br />G and 1). <br />The four member Planning Commission recommended unanimous approval ol the conditional use <br />pemiit for Terance J. Bieker and Jeanne-Marie Varga for the residential property located at 2440 <br />Old Beach Road subject to the condition that the building permit cannot be issued by the Orono stall <br />until the City receives written confirmation that the DNR will issue a permit tor the permanent dock <br />and the dock and site plan have been approved by the LMCD. <br />COUNCIL ACTION REQUESTED: <br />To either adopt or amend the enclosed approval resolution.
