A RESOLUTION GRANTING A VARIANCE <br />TO MUNICIPAL ZONING CODE <br />SECTION 10.24, SUBDIVISION 5 (B) <br />FILE NO. 2106 <br />WHEREAS, William J. Stoddard and Laura C. Stoddard (hereinafter "the <br />applicants") are the owners of the property located at 2605 Kelly Avenue within tlie City of <br />Orono (hereinafter "the City") and legally described as tollows: <br />Lot 5, Block 5, including adjoining vacated 34 feet of Kelly Avenue, City of <br />Orono, Hennepin County, Minnesota (hereinafter "the property"); and <br />WHEREAS, the applicants have applied to the City for a variance to Municipal <br />Zoning Code Section 10.24, Subdivision 5 (B) to permit the rebuilding of an exterior wall of <br />a guest house located 3.1' from the west side lot line where a 10’ setback is required. <br />Minnesota: <br />J. <br />NOW, THEREFORE, BE IT RESOLVED by the City Council of Orono, <br />FINDINGS <br />This application was reviewed as Zoning File #2106. <br />Ihe property is located in the LR-IB, Lakeshore Residential Zoning District <br />requiring one acre in area. The property consists ot 1.68 acres. <br />llie Orono Planning Commission reviewed this application on February 20, 1996 <br />and recommended approval of the proposed variance based upon the following <br />unique findings and hardships: <br />A. Major landscaping improvements were completed at the time ot the <br />renovation of the guest house and to relocate structure to the east iu <br />order to meet the 10' side setback would result in the loss of several new <br />plantings and retaining walls. <br />B.
