Zoning File #2104 <br />January 9, 1996 <br />Page 2 <br />2. <br />J. <br />Section 10.22, Subd. 1: Average setback encroachment not allowed (existing <br />encroachment = 50'; proposed encroachment — house. 13, deck. 19). <br />Section 10.22, Subd. 2/Section 10.56, Subd. 16(L): Hardcover in 75-250’ zone limited <br />to 25% (no variance proposed). <br />Discussion <br />Applicant proposes to construct a new residence to replace the existing residence The new <br />house is proposed to meet the required 30 ’ side setbacks and the 75’ lakeshore setback. <br />The new house will be set back approximately 35 ’ further inland than the existing house, and <br />will include a 6’ deck also meeting the 75’ setback. <br />The averace setback line defined in applicant’s previous application confirms the existing house <br />encroaches approximately 50’ past the average setback. The new construction will encroach <br />only 13 ’ with the new house, or 19 ’ total encroachment including the proposed 6’ deck. The <br />neighboring house to the east will be only minimally impacted by this encroachment, and due <br />to existing'^vegetation will likely have virtually none of its lake views reduced by the proposed <br />construction. <br />The proposed construction includes an attached garage and a redesigned driveway. This may <br />require some fill on the site, and therefore due to past concerns about drainage and its impact <br />on the neichboring property to the east, it would be appropriate for the applicant to provide <br />a grading and drainage ^.ian for the City Engineer to review. Further, because no cutting of <br />e.xistin«’ tirades in the 0-75’ zone will be allowed to accommodate the proposed basement <br />windows "(existing foundation will have to be filled to match existing 0-75’ grades) the elevation <br />of the basement floor is critical. That floor level must be at least 932.5 ’ to meet flood plain <br />ordinance requirements, which would leave approximately 4-4.5’ of till above the basement <br />floor on the lake side of the house, or even 5’ if the grade is established to dram away from <br />the house. Again, these elevations and a complete grading plan are critical to the City s <br />approval of this request. <br />Hardcover Review <br />In the previous application, stall defined that the 75-250’ zone contain 24,600 s.f., which would <br />allow hardcover in the amount of 25'io or 6.150 s.f.
