Mayop^ <br />\•.«k. ^ <br />f 10.0« <br />SEC. 10.OS. AOHINISTRATION JIMD ENFORCEKBIT. <br />Subd. 1. Zoning Administrator. The Zoning Chapter Shall <br />be administered and enforced by the Zoning Administrator, vho ahall <br />be appointed by the Council. <br />Subd. 2. Duties and Authority. The Zoning Administrator <br />shall enforce the Zoning Chapter and also shallx (1) determine <br />that all building permits comply with the Zoning Chapten (2) Issue <br />all zoning occupancy certificates and make and maintain records <br />thereto; (3) conduct inspections of buildings and use of land to <br />determine compliance with the terms of the Zoning Chapter; (4) <br />maintain permanent and current records of the Zoning Chapter, <br />including but not limited to, all maps, amendments, and special <br />uses, variances, appeals and applications therefort (5) receive, <br />file and forward all applications for appeals, amendments, <br />variances, special uses or other matters to the designated official <br />bodies; (6) institute in the name of the City any appropriate <br />actions or proceedings against a violator as provided by law; and, <br />(7) serve as an ex officio non-voting member of the Planning <br />Commission. <br />Published in the Laker/Pioneor newspa, the week of 12/27/93. <br />C <br />* <br />Source; Hunlc(-^al Code <br />rfl' Ive Date. 9-14-67 <br />Subd. 3. Appeals. <br />A. Board of Appeals and Adjustments. The Planning <br />Commission is constituted as the Board of Appeals and Adjustments. <br />The decisions of the Board are advisory to the Council. <br />B. Powers of the Board of Appeals end Adjustments. <br />The Board shall have the following powers; <br />1. Zoning; Appeals and Adjustments. Appeals <br />to the Board of Appeals and Adjustments may be taken by any <br />affected person upon compliance with any of the conditions imposed <br />by the Zoning Chapter. The Board of Appeals and Adjustments has <br />the following powers with respect to the Zoning Chapter; <br />^ ^ (a) To hear and decide appeals where It <br />is alleged that there is an error in any order, requirement, <br />decision, or determination made by an administrative officer in the <br />enforcement of the Zoning Chapter. <br />(b) To hear requests for variances from <br />the literal provisions of the Zoning Chapter in instances where <br />their strict enforcement would cause undue hardship because of <br />circumstances unique to the individual property under <br />consideration, and to grant such variances only when it is <br />demonstrated that such actions will be in keeping with the spirit <br />and intent of the Zoning Chapter.
