?warw^ <br />A RESOLUTION VACATING AN UNUSED <br />PORTION OF DEDICATED DRAINAGE AND <br />UTILITY EASEMENT WITHIN OUTLOT C AND LOT <br />BLOCK 2, BAYVIEW FARMS SECOND ADDITION, <br />SECTION 6, TOWNSHIP 117 NORTH RANGE 23 WEST, <br />IN THE CITY OF ORONO, MINNESOTA <br />FILE NO. 2064 <br />WHEREAS, the City of Orono is a municipal corporation organized and existing <br />under the laws of the State of Minnesota; and <br />WHEREAS, on August 24, 1995. Robert S. Olson and Irvin T. Geffre filed a <br />petition with the City of Orono requesting the vacation of a portion of drainage and utility <br />easements originally dedicated within the plat of Bayview Farms Second Addition, legally <br />described as follows: <br />That portion of the 10.00 foot wide drainage and utility easements centered on the <br />adjoining lot line between Lot 1, Bio A 2 and Outlot C, Bayview Farms Second <br />Addition, Hennepin County, Minnesota de. 'ribed as follows: <br />Beuinning at the southwest comer of said Lot 1; thence North 89 degrees 45 minutes <br />00 seconds east a distance of 148.50 feet; thence south 00 degrees 36 minutes 38 <br />seconds east a distance of 35.00 feet and there terminating. E.xcept the west 10.00 feet <br />of said Lot 1 and the west 10.00 feet of said Outlot C; and <br />WHEREAS, after due published and posted notice, a public hearing was held <br />before the Orono Planning Cor:.nission on September 18, 1995 regarding said vacation and all <br />persons interested were given an opportunity to be heard, and <br />WHEREAS, alter due standing and consideration, the Planning Commission <br />recommended approval of the requested vacation and the Council of the City of Orono finds <br />that said vacation, as proposed, is in keeping with the public interest in consideration of the <br />followimi findings: <br />Page 1 of 3
