m CITYof ORONO <br />RESOLUTION OF THE CITY COUNCIL <br />NO. 7 S ? <br />A RESOLUTION GRANTING <br />VARIANCES TO <br />MUNICIPAL ZONING CODE <br />SECTIOISS 10.22, SUBDIVISION 1, 10.28; SUBDIVISION 5(B); <br />AND 10.56, SUBDIVISION 16(C) <br />FILE #2145 <br />WHEREAS, Donald Helgager and Robin Helgager, husband and wife, <br />(hereinafter "the applicants") are owners of the property located at 3265 6th Avenue North <br />within the City of Orono (hereinafter "City") and legally described as follows: <br />The west 327 feet of the east 542 feet of that part of Government Lot 1, lying south <br />of the road, Section 29, Township 118 North, Range 23 West of the 5th Principal <br />Meridian, Hennepin County, Minnesota (hereinafter "the property"); and <br />WHEREAS, the applicants have applied to the City for variances to Municipal <br />Zoning Code Section 10.28, Subdivision 5(B) to allow a 5' side setback for construction of a <br />new attached garage and room additions, where the required side setback is 30', and a variance <br />to Sections 10.22, Subdivision 1 and 10.56, Subdivision 16(C-6) to allow said additions to <br />encroach the average lakeshore setback where no encroachment is normally allowed, and a <br />variance to Section 10.56, Subdivision 16(C) to allow new structure to be located 140' from <br />Lake Classen, a Natural Environment Lake, where a 150' structure setback is normally required. <br />Minnesota: <br />NOW, THEREFORE, BE IT RESOLVED by the City Council of Orono, <br />FINDINGS <br />1. This application was reviewed as Zoning File #2145. <br />2. The property is located in the RR-IB, Single Family Rural Residential Zoning <br />District. <br />Page 1 of 6
