Box 66 <br />Crystal Bay, MN 55323-0066 <br />December 18, 1996 <br />George Adams, M.D. <br />9581 Virginia Avenue <br />Bloomington, MN 55438 <br />Re: Proposed Street Vacation, Big Island <br />Dear Dr. Adams: <br />The City is in receipt of your letter of request and partial payment for a vacation of portions of the <br />road dedicated in 1888 within the plat of "Pleasant View Lake Minnetonka" on Big Island. <br />As Steve Weckman indicated in his December 10 letter, vacation of this road right-of-way absent <br />a re-dedication of roadway at an alternate location may be in^npropriate. While you may feel there <br />is no practical need to maintain a public roadway at this location, we cannot predict the potential <br />future public uses for such right-of-way, but it may very well be in the public's best interest to <br />preserve some options. <br />In order to better understand the potential ramifications of vacation, the City must answer a number <br />of questions regarding lot line locations, access to adjacent properties, utility line locations, <br />topography, etc. A complete application will require that you provide formal survey work in the area <br />being vacated, as well as detailed information about all e.xisting utilities using the right-of-way. <br />We are especially concerned that access to the property to the east not be eliminated, since that <br />property has nol bee.* declared unbuildable, and in fact identified in City ordinances as being a <br />Substandard Buildable Lot of Record. Further, that property has steep topography near the w etland <br />and its owner may need to gain future access via the road right-of-way to a possible building site <br />near the northwest comer of that lot. <br />We are also concerned that vacating the road behind your property may eliminate the only viable <br />vehicular access to properties along the shoreline to the northwest of you, which have extremely <br />steep lakeshore banks and which may not otherwise be accessible. The types of vehicles which <br />might have occasion to use the right-of-way (for instance on a one-time City permit) might include <br />well drilling tmeks, septic pumpers, construction vehicles, etc. <br />Telephone (612) 473-7357 • FAX 4734)510
