Area 2. That area bounded by U.S Highway 12 on the north. Old Crystal Bay Road on <br />the west, the Burlington Northern Railroad on the south, and the municipal <br />boundary between Orono and Long Lake on the east. <br />Area 3. That area bounded by U.S. Highway 12 on the north, Burlington Northern <br />Railroad on the south, Stubbs Bay Road on the west, and Old Crystal Bay Road <br />on the east. <br />Area 4. That area bounded by Old Cry stal Bay Road on the east. County Road 6 on the <br />north, and U.S. Highway 12 on the south and west. <br />SECTION 3. Study. The City Council on August 14, 1995 adopted Ordinance <br />No. 139, 2nd Series which initiated a study regarding the impact of uevelopment under current <br />ordinances to determine whether they fulfill the underlying purposes of the City’s land use and <br />zoning provisions, and regarding the implications of the potential need for amendments to the <br />City c^e to implement the results of that study. This study is currently underway but has not <br />been completed. <br />SECTION 4. Fxtension of Interim Ordinance. The City Council finds that if <br />would be unwise, improper and unjust to allow development within the Highway 12 corridor <br />until the study as provided in Section 3 has been completed. Section 5 of Ordinance No. 139, <br />2nd Series allows the duration of said Ordinance to be e.xtended by adoption of a subsequent <br />Ordinance for up to 18 additional months after the January 22, 1996 expiration date. Therefore, <br />the City Council hereby extends the interim Ordinance per the provisions of Section 6 below. <br />SECTION 5. Restrictions on the Granting of Preliminarx' Subdivision Approval. <br />Zoning (CUP/Variance) Approval. Rezoninu. PUD or Building Permits. No preliminary <br />subdivision approval. Zoning (CUP/Variance) approval. Rezoning, PUD or Building Permit <br />approval shall be given by the Council for any property within the Highway 12 Corridor as <br />defined herein. <br />SECTION 6. Duration. This Ordinance shall e.xpire on July 22, 1996, without <br />Council action, or it may be repealed earlier if the Council determines that the requisite studies <br />have been completed and adopted and that appropriate evaluation and action, including any <br />necessary revisions of the zoning code, have been finalized. The duration of this Ordinance may <br />be extended by adoption of a subsequent Ordinance for a total of not more than 12 additional <br />months. <br />SECTION 7. Variances. The Council may grant a variance to this Ordinance <br />if the Council finds after careful review of all the facts that a proposal is not contrary to the <br />intent of the Comprehensive Community Management Plan, that it is compatible with the zoning <br />and official control amendments being considered by the City, that it does not adversely impact <br />the health, safety or welfare of the citizens and that it otherwise meets the requirements of the <br />Orono City Code and state law. <br />Page 2 of 3
