X <br />REQUEST FOR COUNCIL ACTION <br />DATE: January 18, 1996 <br />ITEM NO.: <br />Department Approval: <br />Name Jeanne A Mabusth <br />Title Building & Zoning Administrator <br />Administrator Reviewed:Agenda Section: <br />Zoning <br />Item Description:#2094 Rodney Crawford, 4705 North Shore Drive <br />Unimproved Public Road - Resolution_____________ <br />- V'acation of <br />Zoning District: LR-IB <br />Pertinent Ordinance <br />Seaion 10.12 - Vacation of Street <br />Brief Description of Request <br />Mr. Crawford, the applicant, has filed a vacation application to vacate the unimproved platted <br />road right-of-way at the shoreline of his property in order to facilitate the sale of the property. <br />Buvers have conditioned the sale of the property on applicant completing the vacation. <br />Review Exhibits B and H, the current plat map does not designate a public road along the <br />shoreline of the North Shore Drive properties. The 1960 plat map (Exhibit H) correctly shows <br />Lake Street as dedicated in 1888 in the plat of "Bergquist and Wicklund's Park, Hennepin <br />County, Minnesota" Staff has been in contact with the County and the County has confirmed <br />that the right-of-way was never vacated and the plat maps should be amended to reflect the <br />platted right-of-way. Lake Street serves no public purpose and the majority of road area is <br />part of the lakebed of Lake Minnetonka. <br />Review Exhibits E and K, the municipal sewer line is located within the eastern portion of <br />applicant's property and properties to the immediate east. The adjacent property to the east has <br />already dedicated a sewer and utility easement in the plat of Tristana Cove (created in 1981). <br />If Lake Street is to be vacated within the subject property, the City will ask for a utility <br />easement at a 20* width that would extend 10' from the centerline of the sewer line and run <br />'>0' west of the dead end manhole. Applicants have received copies of the utility easements <br />Ind are prepared to complete the easement form for filing. The vacation resolution will be <br />filed by the City as soon as the Hilly executed utility casement is received by the City. <br />As staff has determined no public interest in the remaining portions of the unimproved right-of- <br />way of Lake Street, the owner to the immediate east and property owners to the west of the <br />Crawford property may petition the City for the comprehensive vacation of Lake Street <br />COUNCIL ACTION REQUESTED: <br />To cither approve or amend the enclosed approval resolution that has been drafted per the <br />unanimous approval recommendation of the Planning Commission.
