Zoning File #2078 <br />November 13, 1995 <br />Page 2 <br />Easement area = .43 acres <br />Total area of proposed Lot 2 = 3.5 acres <br />Adjusted lot area = 3.07 acres <br />Required = 1 acre. <br />The futrire owner of Lot 2 shall be advised that if property is located within the MUSA and <br />is further subdivided per the 1 acre zoning standards, the City may consider asking for future <br />extension of public roads from south. Lot 2 is currently subdivided based on rural standards. <br />Review Exhibit B, Hennepin County has reviewed the two lot proposal and will not seek an <br />additional dedication of right-of-way on County Road 135 (Tonkawa Road). The County will <br />deny a third curb cut Access to Lot 2 must be via the existing driveway easement at the <br />souAeast comer of proposed Lot 2. Lot 1 will continue to achieve access via the existing curb <br />cut Any alterations or upgrades of these curb cuts must be approved by Hennepin County via <br />a permit. <br />Staff Recommendation <br />Staff recommends approval of the Class II subdivision application of Jensen Homes Inc. <br />involving the Frank Bennett property located at 405 Tonkawa Road finding all standards of the <br />on-site septic code, LR-IA/LR-IB zoning districts and pertinent sections of the subdivision <br />regulations have been satisfied. Approval is subject to the following conditions: <br />1. No more than nvo residential units can be served by the existing easement drive. <br />2.Access to Lot 1 shall be via an existing curb cut at the County Road. Access <br />to Lot 2 shall be via the existing private driveway at the southeast comer of Lot <br />3. <br />4. <br />5. <br />Tennis court located within Lot 2 that encroaches the lot line shall be removed <br />before building permit is issued for new constmction on either Lots 1 or 2. <br />Septic site must be staked and protected prior to the removal or demolition of <br />the tennis court. <br />All building envelopes shall be defined by the required setbacks for cither the <br />LR-IB or LR-IA zoning district. <br />Applicant to provide a soil delineation map and report prior to application being <br />scheduled before the Council.
