A RESOLUTION GRANTING PRELIMINARY <br />APPROVAL FOR OF A CLASS II SUBDIVISION AT <br />THE PROPERTY LOCATED AT 405 TONKAWA ROAD <br />- FILE NO. 2078 <br />WHEREAS, Jensen Homes, Inc., a Minnesota corporation, on September 22, 1995, <br />filed a formal subdivision application with the City for approval of a two lot residential plat of <br />property legally described as: <br />Tracks A and B and the Southerly 132 feet of the Westerly 205 feet of Track C, Registered <br />Land Survey No. 540, files of Registrar of Title, County of Hennepin, Minnesota (hereinafter <br />"the property"); and <br />WHEREAS, after due published and mailed notice in accordance with Minnesota <br />Statutes 462.358 et. seq. and the City of Orono ’s Zoning and Platting Codes, the Orono Planning <br />Commission held public hearings on October 16 and November 20, 1995, at which time all persons <br />desiring to be heard concerning this application were given the opportunity to speak ther-on; and <br />WHEREAS, at their regular meeting held on January 8, 1996, the Orono Oty <br />Council considered the subdivision application of Jensen Homes, Inc. noting the following findings <br />of fact: <br />1.The property is located within both the LR-1 A, Single Family Lakeshorc Residential <br />District, requiring 2 acres of contiguous dry buildable land within each newly created <br />lot and tlie LR-IB, Lakeshore Residential Zoning District, requiring a minimum of <br />1 acre of buildable land within each newly created lot. <br />2. The property contains a total of appro.ximately 10.69 acres, all of which is considered <br />dr\- buildable except for a drainage way that intersects the property to the southeast. <br />3. The proposed plat contains 2 lots as follows: <br />Lot 1, located predominately in the LR-1 A Zoning District, is required to maintain <br />2 acres of area and consists of 7.19 acres. <br />Page 1 of 5 I
