Request for Council Action continued <br />Page 3 <br />January 4, 1996 <br />Zoning File <5^1958 Louis Oberhauser, 2405 Dunwoody Avenue, 3865/3877 Shoreline Drive <br />Refer to Exhibit A, the Council Action Notice of December 12, 1995, which staff contends <br />reflects the directives of the Council concerning the removal of the structures and the deadline <br />for the removal. It was also staffs understanding that the applicant was to provide a fully <br />executed developer's agreement and post an appropriate form of security to ensure that removal <br />by the January 8th meeting. Mr. Oberhauser did not recognize this as Council's direction <br />although he has agreed to submit a fully executed developer's agreement (not yet received as <br />of this writing). He has advised that he is unable to provide a letter of credit or cashier's <br />check because of his financial situation as a result of his recent divorce. He has advised that <br />he would execute an agreement confirming this hardship and offering another option to ensure <br />the removal. The applicant has advised that he is working with a contractor who has <br />confirmed that he will be able to remove the two boarded up structures before the end of the <br />month. Oberhauser has attempted to contact the Fire Chief at the Mound Fire Department to <br />determine if it would be feasible to bum the structures. Because of the holiday season, he has <br />not been able to contact the Fire Chief He has advised staff that the Fire Chief will be <br />available as of January 8th and may be able to report something conclusive by your meeting. <br />Please contact staff prior to the meeting if Council wishes staff to provide any further <br />information or if you wish applicant to provide additional information by your meeting. <br />COl I'.CIL ACTION REQUESTED: <br />To either approve or amend the enclosed approval resolution <br />:! <br />j
