<br />3 <br />227533v1 <br />terms of this Contract. If the Plans vary from the terms of this Contract, the terms of this Contract <br />shall control. The Plans are: <br /> <br />Plan A – Plat of Wildhurst Forest <br />Plan B – Plan for Public Sanitary Sewer Extension <br /> <br />7. Improvements. <br /> <br />A. Developer shall install and pay for the following as required to be built in accordance <br />with the approved Plans (the “Improvements”): <br />i. Public Sanitary Sewer Extension, described in Section 8 of this Contract <br />ii. Setting of Iron Monuments <br />iii. Surveying and Staking <br />iv. Private access driveway over Outlot A <br /> <br />B. The Improvements shall be installed in accordance with the Plans; the City zoning <br />code; City standard specifications for utilities construction; and any other ordinances <br />including those concerning erosion and drainage and any prohibiting grading, <br />construction activity, and the use of power equipment. <br /> <br />C. Developer shall submit plans and specifications which have been prepared by a <br />competent registered professional engineer to the City for approval by the City <br />Engineer. Developer shall instruct its engineer to provide adequate field inspection <br />personnel to assure an acceptable level of quality control. In addition, the City may, at <br />the City’s discretion and at Developer’s expense, have one or more City inspectors and <br />a soil engineer inspect the work as the City may reasonably determine. Developer, its <br />contractors and subcontractors, shall follow all instructions received from the City’s <br />inspectors. <br /> <br />D. Developer’s engineer shall provide for on-site project management. <br /> <br />E. Developer’s engineer is responsible for design changes and contract administration <br />between Developer and Developer’s contractor. Developer or its engineer shall <br />schedule a pre-construction meeting at a mutually agreeable time at the City Council <br />chambers with all parties concerned, including the City staff, to review the program for <br />the construction work. <br /> <br />F. Within thirty (30) days after the completion of the Improvements and before the <br />Security is released, Developer shall supply the City with a complete set of <br />reproducible “as constructed” Plans, and an electronic file of the “as constructed” Plans <br />in an auto CAD file based upon the Hennepin County coordinate system, all prepared <br />in accordance with City standards. <br /> <br />8. Sewer Extension. As part of the Improvements, Developer shall be responsible, at <br />Developer’s sole cost and expense, for all aspects of the extension of a public sewer to serve the <br />Property and other property addressed 1007 Wildhurst Trail owned by the Developer (PID 07-DRAFT
