3 227533v1 terms of this Contract. If the Plans vary from the terms of this Contract, the terms of this Contract shall control. The Plans are: Plan A – Plat of Wildhurst Forest Plan B – Plan for Public Sanitary Sewer Extension 7. Improvements. A. Developer shall install and pay for the following as required to be built in accordance with the approved Plans (the “Improvements”): i. Public Sanitary Sewer Extension, described in Section 8 of this Contract ii. Setting of Iron Monuments iii. Surveying and Staking iv. Private access driveway over Outlot A B. The Improvements shall be installed in accordance with the Plans; the City zoning code; City standard specifications for utilities construction; and any other ordinances including those concerning erosion and drainage and any prohibiting grading, construction activity, and the use of power equipment. C. Developer shall submit plans and specifications which have been prepared by a competent registered professional engineer to the City for approval by the City Engineer. Developer shall instruct its engineer to provide adequate field inspection personnel to assure an acceptable level of quality control. In addition, the City may, at the City’s discretion and at Developer’s expense, have one or more City inspectors and a soil engineer inspect the work as the City may reasonably determine. Developer, its contractors and subcontractors, shall follow all instructions received from the City’s inspectors. D. Developer’s engineer shall provide for on-site project management. E. Developer’s engineer is responsible for design changes and contract administration between Developer and Developer’s contractor. Developer or its engineer shall schedule a pre-construction meeting at a mutually agreeable time at the City Council chambers with all parties concerned, including the City staff, to review the program for the construction work. F. Within thirty (30) days after the completion of the Improvements and before the Security is released, Developer shall supply the City with a complete set of reproducible “as constructed” Plans, and an electronic file of the “as constructed” Plans in an auto CAD file based upon the Hennepin County coordinate system, all prepared in accordance with City standards. 8. Sewer Extension. As part of the Improvements, Developer shall be responsible, at Developer’s sole cost and expense, for all aspects of the extension of a public sewer to serve the Property and other property addressed 1007 Wildhurst Trail owned by the Developer (PID 07-DRAFT
