This application is regarding approval of an average lakeshore setback variance. <br /> <br />2. MN§15.99 Application Deadline. The application was received on July 19, and considered to be <br />complete on August 10, 2023. Therefore the 60-Day review period expires on October 9, 2023. <br /> <br />3. Background/ Summary. In 2022, Council approved Resolution No. 7259 granting an average <br />lakeshore setback variance was granted for additions and modifications to the existing home within the <br />setback. Since that time, the owners shifted the scope of the project from an addition to a new build. The <br />variances granted in 2022 remain in effect and the overall home will comply with the zoning setbacks as <br />well as the variance approvals. However, the new <br />plans reflect a change in the roof shape, height, <br />and mass within the average lakeshore setback <br />which will require a new average lakeshore <br />setback variance. <br /> <br />4. Variance Description. The property it is <br />situated on somewhat of a peninsula-like knob in <br />the shoreline. This results in challenges regarding <br />the application of the average lakeshore setback <br />line. Because of the orientation of the neighboring <br />homes the setback line is approximately 20 feet <br />further from the lake than the neighbor to the <br />south. <br /> <br />The previously contemplated footprint additions to the home were designed to minimize the impact to the <br />adjacent properties and their views of the lake. The approved additions encroach into the average <br />lakeshore setback 15 feet. For architectural reasons the applicant has redesigned a more appropriately <br />scaled roof which, due to the average lakeshore setback, requires a setback variance on the lake side of <br />the home. The inset photo depicts a three-dimensional view of the average lakeshore setback impact. The <br />red shaded areas represent the existing home and approved encroachments. Refer to Exhibit C for <br />additional 3D views. Additionally, the current plan reflects the following changes from the original <br />approval (which do not require variances): <br />• The footprint on the north side of the home was adjusted to meet the side yard setback. <br />• The footprint on the street side of the home has been adjusted and increased. <br />• The garage footprint was enlarged and rotated 45 degrees creating a courtyard. <br /> <br />5. Planning Commission Vote and Comment. On August 21st, the Planning Commission held a public <br />hearing. The Commission discussed the improved setbacks provided with the new home footprint and <br />noted the change in the roof line from a hip to a gable-style within the average lakeshore setback should <br />not restrict any views of the lake. Following the public hearing, the Planning Commission voted 6 to 0 in <br />favor of a motion for approval of the average lakeshore setback variance as presented.
