The property owners have requested an encroachment agreement to address their existing <br />driveway improvement within an undeveloped right-of-way. <br /> <br />2. Background/ Summary. The property owners have an existing driveway located within the adjacent <br />unimproved right-of-way on the south side of their property (see the below aerial photo). A portion of the <br />existing driveway is located within the unimproved right-of-way. The owners have requested an <br />encroachment agreement to address the driveway encroachment. <br /> <br /> <br />3. Analysis. Granting the encroachment agreement will not interfere with access to the right-of-way. <br />The Agreement will allow the property owners to continue to use and maintain their driveway within <br />unimproved City right-of-way which is not planned to be improved. <br /> <br />The City Engineer provided comment supporting the Encroachment Agreement request (attached as <br />Exhibit C). <br /> <br />4.
