The existing deck encroaches into the average lakeshore setback by <br />approximately 5 feet. The existing deck meets all other setback requirements including the 75 -foot lake <br />setback. The proposed screened in porch addition will maintain the 75 -foot lake setback and will not <br />impact hardcover. The property currently meets the hardcover requirements with the hardcover at <br />approximately 21% of the lot. <br />Practical Difficulties Analysis <br />Applicant Submittal Information: The applicant has identified the existing conditions of the property as a <br />practical difficulty. The existing deck is partially within the average lakeshore setback and the applicant <br />proposes to maintain that setback. The home is situated on the property in such a way that the screened <br />in porch expansion would not impact the lake views of the neighboring property. <br />Planning Staff Practical Difficulty Analysis: Staff agrees with the applicant's assessment. The average <br />lakeshore setback for the property is determined by only one neighbor, 3265 Bohns Point Lane. Because <br />there is only one neighboring property, the average lakeshore setback line is a flat setback of 70 feet, <br />which is the neighbor's distance from the OHWL.
