4. <br />5. <br />6. <br />7. <br />C. All dwelling units are attached but not more than 4 (four) units allowed <br />per structure. <br />D. The maximum height shall not exceed 30 (thirty) feet. <br />E. <br />F. <br />No more than 35% of the zoning lot is hardcover. <br />A minimum of 2 (two) parking spaces are provided for each dwelling <br />unit. At least one parking space shall be enclosed and attached to the <br />principal structure it serves. <br />The proposed plat meets the zoning requirements in the LR-lC-1 district for side <br />and rear yard setbacks. The proposal meets the front yard setback from <br />Shoreline Drive. The proposed townhomes are 15' from the dedicated right-of- <br />way for Livingston Avenue and 22' from the private driveway where 30' is <br />required for a front yard setback. The proposed 15' and 22' from the Livingston <br />Avenue right-of-way and private driveway, respectively, meet the intent of the <br />Planned Residential Development by preserving 25 more trees with the proposed <br />building alignment. <br />The subject property is deciduous woodland with large oak, sugar maple and <br />American basswood trees. <br />The subject property contains two isolated wetlands. The larger wetland at the <br />south end of the parcel is a designated Department of Natural Resources <br />Protected Wetland (Type 3 shallow marsh PEMIF) and is subject to Department <br />of Natural Resources regulations below the Ordinary High Water Level (OHWL). <br />The northwest comer of the property is a Type 7 wooded swamp (PFOSC), <br />Concurrent with the subdivision application, the subdivider has also submitted <br />an application for a Planned Residential Development for a 30 unit townhome <br />development. <br />NOW, THEREFORE, BE IT RESOLVED, that based upon one or more of <br />the findings noted above, the City Council of the City of Orono hereby approves the <br />preliminary plat for Brook Park Realty for the property located at 3700-3760 Shoreline Drive <br />per the survey dated 9-25-97 as revised on 11/25/97 by Westwood Professional Services, Inc., <br />subject to the following conditions: <br />Page 2 of7 <br />1
