the Permit being violated during the course of the bum, pollution or nuisance <br />conditions developing during the course of the bum, or a fire smoldering with no <br />flame present. <br />Subd. 11. Denial of Open Burning Permit. If established criteria for the issuance of <br />an Open Burning Permit are not met or during review of said application, it is <br />determined that a practical alternative method of disposal of the material exists, or <br />a pollution or nuisance condition would result, or if a bum event safety plan cannot <br />be drafted to the satisfaction of City staff, then the City of Orono staff person may <br />deny the Open Burning Permit application. <br />Subd. 12. Burning Ban or Air Quality Alert. No Recreational Fire or Open Bum <br />will be permitted when the City's Fire Chief, Fire Marshall, City's Police Chief or <br />DNR has officially declared a burning ban due to potential hazardous fire conditions <br />or when the MPCA has declared an Air Quality Alert. <br />Subd. 13. Rules Adopted bv Reference. Minnesota Statutes 88.16 to 88.17 and <br />88.171 and Minnesota Uniform Fire Code are hcitby adopted by reference and made <br />a part of this Ordinance as if fully set forth herein. <br />Subd. 14. Penalty. Any person violating any provision of this chapter is guilty of <br />a misdemeanor and upon conviction, shall be punished by a fine and/or <br />imprisonment. <br />Subd. 15. Liability. In addition to any criminal liability, the person violating any <br />provision of this Chapter shall be responsible for all costs incurred by the City, and <br />fire department, and any adjoining property owners, as a result of the bum, including, <br />but not limited to, fire suppression costs, property damage, personal injury and <br />administrative fees. <br />Section 3. Adoption and Publication. This ordinance shall be published in The Pioneer and <br />The Laker newspapers and become effective immediately upon publication. <br />Adopted by the City Council of Orono, Minnesota on this <br />_____, 199__by a vote of ____ayes and_____nays. <br />day of <br />ATTEST: <br />Dorothv M.
