B. The existing structure is a legal, non-conforming duplex. <br />C. The existing structure does not meet the required front setback. <br />D. The proposed stmcture will meet all setback and hardcover requirements. <br />E. The presence of "Outlot A" restricts redevelopment as a single-family <br />residence. <br />F. The subject lot is not adjacent to a commercial or industrial district. <br />G. The subject lot is within 250’ of the B-3 District. <br />H. The proposed building site is approximately 100' from the front property <br />line and within 400' of a commercial district. <br />4. <br />5. <br />The C^’mcil fmds that the conditions existing on this property are peculiar to it and <br />do n» ply generally to other propcity in this zoning district; that granting the <br />varia. would not adversely affect traffic conditions, light, air nor pose a fire <br />hazard or other danger to neighboring properties, would not merely serve as a <br />convenience to the applicant, but is necessary to alleviate a demonstrable hardship <br />or difficulty; is necessary to preserve a substantial property right of the applicant; <br />and would be in keeping with the spirit and intent of the Zoning Code and <br />Comprehensive Plan of the City. <br />The City Council finds that granting a conditional use permit to allow construction <br />of a new two-unit townhome will not be detrimental to the health, safety or general <br />welfare of the public, would not adversely affect light, air nor pose a fire hazard <br />or other danger lo neighboring property, nor will its use depreciate surrounding <br />property values and that the proposed level of use of the property will be in <br />keeping with the intent and objectives of the Zoning Code and Comprehensive Plan <br />of the City. <br />Page 2 of 4
