Planning and Zoning Administrator <br />City of Orono <br />Post Office Box 66 <br />Crystal Bay, Minnesota 55323 <br />Re: Brook Park Realty <br />File No. 139-2263 <br />Dear Mike, <br />Our previous letter of July 16 did not mention the fact that a portion of the wetland area on site is <br />under the jurisdiction of the Department of Natural Resources, designated at basin 27-914W. <br />DNR wetlands are regulated at the ordinary high water level (OHWL). The OIWL is an <br />elevation determined in the field by the location of certain wetland features. It is likely that <br />additional wetland areas exist around the fringe of the OHWL, at higher elevations. These <br />wetlands are under the jurisdiction of the Wetland Conservation Act (WCA) and Corps of <br />Engineers. The DNR does not allow the impact of wetland areas under their jurisdiction for <br />development purposes. If the development proceeds, the DNR should be asked to determine the <br />OHWL of the wetland. The proposed roadway will need to be realigned if any portion <br />encroaches below the OHWL.
