The <br />applicant should also be asked for their testimony regarding this issue. <br />Criteria for Determining Undue Hardship <br />1. The property in question cannot be put to a reasonable use if used under conditions <br />allowed by the official controls. <br />The existing residence and attached three car garage could continue to be used in their <br />current state. The architect has indicated in attachment J that many features of the current <br />residence are substandard. <br />2.The plight of the landowner is due to circumstances unique to his property not created <br />by the landowner. <br />3. <br />The property is located on an isthmus, severely restricting the allowable building pad. <br />The variances, if granted, will not alter the essential character of the locality. <br />The variances for lakeshore setback and hardcover will not change the character of the <br />area. <br />4.
