IX. Summary <br />A. Current Policies <br />Following is a summary of the City's current written and unwritten <br />hardcover policies: <br />1. The items listed in Section IV-A of this document are considered as <br />hardcover. <br />2. No 'partial hardcover' credit will be granted for any of those items <br />listed, even though it may be demonstrated that they are permeable to <br />some degree. <br />3. A property is considered to be not in compliance if any individual <br />hardcover zone has hardcover in excess of the allowed hardcover <br />square footage for that zone as established in the Zoning Code. <br />EXCEPTION A: Allowed hardcover in the 0-75' zone <br />consisting of a compliant lakeshore stairway, compliant <br />lockbox, or approved retaining walls shall not constitute non- <br />compliance, except that such hardcover shall be debited against <br />the 75-25C ’ zone allowance. <br />EXCEPTION B: Unused hardcover allowance from a zone <br />closer to the lake can be credited toward a zone further from the <br />lake. <br />4. Structural hardcover and non-structural hardcover is defined per the <br />definitions of Section V-A of this document. <br />5. When hardcover is not compliant in a zone in which construction <br />requiring a building permit is proposed, (or if any zones closer to the <br />lake are not compliant?): <br />A. No building permits for work outside the existing developed <br />envelope of a structure shall be issued unless variance approval <br />is granted. <br />B. Non-structural hardcover shall not be converted to structural <br />hardco’. er without variance approval, nor shall intensification <br />of hardcover be allowed. <br />EXCEPTION: A second story may be constructed above <br />an existing building's first story without a variance if the <br />existing building is legally located.
