Within <br />250 to 500 feet of the shoreline there shall be no greater than 30% <br />hardcover. Within 500 to 1,000 feet of the shoreline there shall be no <br />greater than 35% hardcover. <br />I <br />r- <br />- 10.55 Flood Plain and Wetlands Management; <br />Subd. 8, Development Restricted: Prohibition. Except <br />as hereinafter specifically permitted, no filling, grading, dredging, <br />excavation, hardcover, temporary or permanent structures, <br />obsuiictions, septic systems, well or other construction shall be allowed <br />within the Flood Plain and Wetlands Conservation Area; nor on any <br />lands within 26 feet thereof; nor on any land within 75 feet of the <br />ordinary high water elevation of any lake shoreline, nor on land <br />abutting, adjoining or affecting said area if such activity upon those <br />adjacent areas is incompatible with the policies expressed in this <br />Section and the preservation of those conservation areas in their natural <br />state. <br />10.56 Shoreland Management: <br />Subd. 16(L). Hardcover Limitations. <br />1. No hardcover or impervious surface shall be <br />placed, located, or constructed within 75 feet of the Ordinary High <br />Water Level of any lake or tributary , except for stairways, lifts, <br />landings and lockboxes as regulated elsewhere in the Municipal Code. <br />2. Between 75 feet and 250 feet of the OHWL <br />there shall be no greater than 25% hardcover. Between 250 feet and <br />500 feet of the OHWL there shall be no greater than 30% hardcover. <br />Between 500 feet and 1,000 feet of the OHWL there shall be no greater <br />than 35% hardcover. <br />- 10.03 General Provisions: <br />Section 10.03, Subd. 4. Prohibition. It is unlawful to <br />convert, enlarge, reconstruct or alter any structure or use any structure <br />or land for any purpose nor in any manner which is not in conformity <br />with the Zoning Chapter. <br />Note: The City has used this section as its authority to require <br />adheren ce to hardcover requirements before building permits will be <br />issued for projects that create or replace hardcover.
