driveway in Outlet B, Lot 2 shall not have direct access to Lyman Avenue other <br />than via Outlet B. The subdivider shall submit an acceptable grading and drainage <br />plan for the shared driveway prior to final plat approval : such plan shall include <br />drainage improvements within the right-of-way of Lyman Avenue as deemed <br />necessary bv the City Engineer. The driveway when constructed by the owner(s) <br />of Lots 1 and 2 shall adhere to the approved plan unless the City approves an <br />amendment to the plan . <br />^2*. At" the time of building permit approval or driveway constnietion for Lot 1. the <br />owner of Lot 1 shall provide Prior ti < final plat approval the subdivider shall submit <br />a screening plan acceptable to the City for sufficient additional screening near the <br />southeast comer of Lot 1 to prevent minimize and reduce vehicle headlights from <br />shining into the rear yard of 1290 Lyman Avenue. Such screening improvements <br />shall be carried out at the time of building permit approval or driveway constmetion <br />for Lot 1. whichever occurs first. <br />Subdivider shall draft for City approval, and execute, restrictive covenants to be <br />placed on Outlot A to prevent uses of said Outlot for all purposes except as a <br />vegetative and separation buffer between Outlot B and 1290 Lyman Avenue. <br />Sr&t Septic sites on Lots 1, 2 and 3 shall be stake.* .id protected prior to any land <br />alterations on this property that may include a ightline improvernem s within the <br />newly dedicated right of way, driveway construction, etc. <br />^JiL. Subdividcr shall dedicate addi tional public right-of-way fot Lyman Avenue on the <br />plat m order to allow future upgrade s of Lyman Avenue -to conform as close aa <br />possible to the required 275* curve rad ius for a 30 mph roadway.Subdivider shall <br />designate the private road portion of Lyman Avenue as Outlot C on the plat per the <br />sketches bv Merila & Associates labeled "Exhibits C-1 and C-22. 9-21-97. Sheets <br />1 and 2 of 2. 97-104". Subdivider shall grant to the City the standard underlying <br />Road and Utility Easement for Outlot C <br />4Br The-€ity agrees to grant an casement over the newly dedicated right of way in <br />favor of Lot 2 for construction, use and -ma intcnancc of a septic system, with the <br />stipulation that the City will not upgrade the road tn a manne r that impacts the <br />septic system until such time that the system is no longer in use. <br />Page 6 of 9
