m <br />CITYof ORONO <br />RESOLUTION OF THE CITY COUNCIL <br />NO. 3 7 ^ <br />A RESOLUTION GRANTING VARIANCES <br />TO MUNICIPAL ZONING CODE <br />SECTIONS 10.22, SUBDIVISIONS 1 AND 2, <br />10.55, SUBDIVISION 8, AND <br />10.56, SUBDIVISION 16 (C & L) <br />FILE NO. 2159 <br />9 <br />WHEREAS, James and Joann Jundt (hereinafter "the applicants") are the owners <br />of the property located at 1400 Bracketts Point Road within the City of Orono (hereinafter "the <br />City") and legally described as follows: <br />(Exhibit A attached); and <br />WHEREAS, the applicants have applied to the City for variances to Municipal <br />Zoning Code Sections 10.22, Subdivisions 1 and 2, 10.55, Subdivision 8 and 10.56, Subdivision <br />16 (C & L) to permit the restoration of an existing retaining wall, underground grotto an <br />lakeshore stairway system located within the 0-75' lakeshore setback zone where no hardcover <br />or structure is normally allowed. <br />NOW, THEREFORE, BE IT RESOLVED by the City Council of Orono, <br />Minnesota: <br />1. <br />2. <br />3. <br />FINDINGS <br />This application was reviewed as Zoning File #2159. <br />The property is located in the LR-IA Single Family Lakeshore Residential <br />Zoning District. <br />The Orono Planning Commission reviewed this application on September 16, <br />1996 and recommended approval of the proposed variances to restore the <br />lakeshore stairway system, retaining wall and underground grotto, based upon the <br />following findings: <br />Page 1 of 5
