Gaffron said in Staffs opinion the only <br />rationale for approving the garage is based on the fact there is an existing garage. <br />Gaffron said the negative visual impacts of the structure located 1’ from street right-of- <br />way should outweigh the convenience aspect of the structure. He indicated the doors <br />would be located to the side rather than on the street side and the garage would not have <br />a driveway. Gaffron indicated the code does allow for a 20 s.f. lock box, 4' in height and <br />within the 0-75' zone, but this would not provide the storage needs of the applicant. <br />Staff questioned whether the garage could be located elsewhere on the property. Staff <br />does not recommend approval of the garage based on the facts found. <br />Gaffron said Staff does not recommend location of a fence in the right-of-way. The <br />existing fence is in poor condition. A conforming location would be 20' or more from <br />the traveled road. Staffs opinion is a fence located 10' from the road would have more <br />of a visual impact and possibly create a problem with snow storage. The Planning <br />Commission recommended approval of fence replacement with a height of 6' and located <br />10' from pavement. <br />Staffs recommendation for the fence would be a location at least 15' from the road with <br />existing shrubbery located in front of it for screening and additional screening planted to <br />essentially make it disappear from view. A hold harmless agreement would be required. <br />Gaffron noted that a major portion of the fence would be within 75' of the shoreline. <br />Jabbour asked about the location of the pavement on the right-of-way. Gaffron said the <br />20' paved road is fairly centered within the 66’ wide right-of-way. There have been <br />survey markers placed in the past. It appears that the fence is in the used portion of the <br />property due to the wide right-of-way. <br />Jabbour asked Barrett to comment on locating a fence within the right-of-way. Barrett <br />said if it was approved, it should be subject to the right to expand the right-of-way if <br />necessary. <br />Brooks indicated that the variance requests w'ere part of his plan for improvements of the <br />acquired Skarp property. He said he removed the house that was located on Lot 11 and <br />eliminated hardcover. The proposed garage would be used for storage as the home is <br />located on an island and has no good area for a storage structure to house seasonal <br />equipment. Brooks noted many of the same problems would be encountered if he <br />attempted to locate the garage on the main property. He is walling to add plantings <br />where necessary. <br />8
