Also see the application <br />(attachment A). <br />Criteria for Determining I Indue Hardship <br />1.The property in question cannot be put to a reasonable use if used under conditions <br />allowed by the official controls. <br />The property could be put to a reasonable use without the construction of the deck. <br />The proposed deck is a replacement for a similar, previously existing one, however. <br />2.The plight of the landowner is due to circumstances unique to his property not created <br />by the landowner. <br />The owner was not aware of the need for a permit to replace an existing deck. The <br />previous deck was constructed prior to the current hardcover and setback requirements. <br />3.
