r <br />•to-. <br />COUNCIL MEETING <br />OCT 1 3 1997 <br />REQUEST FOR COUNCIL ACTION <br />CITYOFORONO <br />DATE: October 8,1997 <br />ITEM NO = ^ <br />Department Approval: <br />Name Ron Moorse <br />Title City Administrator <br />Administrator Reviewed:Agenda Section: <br />City Administrator’s Report <br />Item Description: Approval of New Prosecuting Attorney <br />In 1992, the City joined with the cities of Minnetonka Beach, Minnetrista, St. Bonifacius and <br />Minnetonka in a cooperative arrangement for the provision of prosecution services. The <br />arrangement involved the city of Minnetonka providing prosecution services to the four other cities. <br />This arrangement has provided very cost effective prosecution services to all participating cities for <br />nearly six years. As the statutes and requirements related to prosecution services have changed, the <br />work load has grown to a point where the city of Minnetonka can no longer provide prosecution <br />services to the current group of cities at the current staffing level. In addition, there are a number <br />of difficulties related to expanding Minnetonka's staff, including a lack of space and a substantial <br />increase in costs. Due to this situation, Orono staff have been working to identify other options for <br />prosecution services. <br />Staff has discussed with the cities of Spring Park, Minnetonka Beach and Long Lake the concept of <br />contracting jointly for prosecution services. This seems like a natural grouping since Orono provides <br />police services to all three cities. The city of Spring Park is very satisfied with their current <br />prosecuting attorney and wants to remain with him. Staff approached the Spring Park prosecuting <br />attorney to request a proposal for providing prosection services to Spring Park, Minnetonka Beach, <br />Long Lake and Orono. <br />The City has received three proposals for prosecution services, all from well-qualified attorneys with <br />substantial experience prosecuting in Hennepin County. The proposals are as follows: <br />Kenneth N. Potts $27,500/yr <br />Gregory E. Keller $32,400/yr <br />Tallen and Baertschi $42,000/yr <br />The lowest cost proposal was received from Kenneth N. Potts, who has been providing prosecution <br />services for the cities of Excelsior, Shorewood and Tonka Bay for the past six years. These cities <br />indicate he has provided them with excellent service. Mr. Potts has indicated he is willing and able <br />to provide prosecution services to the cities of Orono, Minnetonka Beach and Long Lake. The <br />proposed fee for the city of Orono for 1998 is $27,500 per year. This is substantially lower than the <br />1997 contract cost with the city of Minnetonka which is $36,500.
